Re: working on rest day

Hi,

I would like to enquiry abt working on rest day:

1. if working 2 hrs on rest day, the calculation should be(Basic/26 days/8hrs) x 4 hrs, is it correct for salary range below RM1.5k?

2. if for staff earning above RM1.5k, will be entitled for half day RO if working less than 4 hours on rest day, right? If he/she works for more than 8 hours on rest day, will be entitled for 1 day of RO or pay in lieu?


As my current company practice the following formula: (Basic/26/8hrs) x 2 times x 2 hrs.

1. Company's formula (Basic/26/8hrs) x 2 times x 2 hrs is correct.

2. Go according to the following section of the Employment Act

"60(3) (b) In the case of an employee employed on a monthly rate of pay who works on a rest day, he shall be paid for any period of work:

(i) which does not exceed half his normal hours of work, wages equivalent to half the ordinary rate of pay for work done on that day; or

(ii) which is more than half but which does not exceed his normal hours of work, one day's wages at the ordinary rate of pay for work done on that day. "

That means working less than 4 hours, you pay half day salary at ORP, more than 4 hours one day.

However, how will be the formula like if the staff work MORE THAN 8 hours on rest day?

That formula (Basic/26/8hrs) x 2 times x 2 hrs. is for overtime after 8 hours normal work. Have I misunderstood your question 1? Did you mean working for only 2 hours on a rest day? If it is so, he should be paid half day's salary as stated in 60(3)(i).

what salary range of 1.5k your referring to? it is basic only or including allowances?

Do the company have the right not to pay your OT if they say so and its according to their company policy?

Meaning to say we are paying staff lesser if based on our current practice [(basic/26/8)x2 times x 1 hour].

Ok. We will amend our calculation then. Thanks a lot..

Staff on monthly basis Work on rest day from 8am - 5.30 pm, kindly show the calculation. (normal hour start from 9am - 5.30 pm) .Thanks
