Re: UNPAID LEAVE FOR NON-CONFIRMED STAFF
I found a query from other reader, as follows:
My colleague probation and confirmation was due in October 2008.
However the company did not issue any letter of confirmation.
In December 2008, she applied for 2 days annual leave and it was approved and she went for her annual leave.
Recently in January 2009, she submitted her resignation as she is getting marry and shifting.
Now, after calculating her last day of service, the HR manager has requested to deduct her salary of the annual leave she has taken in december 2008 with the reason she was not confirmed, therefore she is not illegible for the annual leave.
Is this within the HR manager's right to do so?
Am i right to say, that if we do not receive a confirmation within a month of our confirmation due and we continued to service the company there after, we are automatically considered confirmed and therefore entitle to our annual leave.

For deduction of salary for the 2 days, she can make a complaint at the Labour Office.

I HAVE A QUESTION ON THE ABOVE MENTIONED :
why can't the company deduct her salary, since she is not receive the confirmation letter yet? a non confirm staff should not entitle for paid leave. am i right?
i see nothing wrong on the company for being deducted her salary.
