I work in Hotel Industry with a basic of RM240 + 3.5points. It just strike my mind when i see my overtime rates which is RM3 didn't change at all for the past 2 1/2 yrs. Even after the promotion which increase my basic to RM500 + 4points..

Is the rates given by the Company are true because if i 'm not mistaken the overtime rates change with increment of the basic and there is a specific calculation to this matter....

Right me if i'm wrong.

Yes. The OT rate shall not be less than 1.5 X hourly rate of pay. But in hospitality and F&B industries, it is common to see a fixed OT rate being used.

"EA Sec.60A(3)(a) For any overtime work carried out in excess of the normal hours of work, the employee shall be paid at a rate not less than one and half times his hourly rate of pay irrespective of the basis on which his rate of pay is fixed."

You should be paid RM3.60 now with the basic of RM500.00. You were overpaid when your basic is RM240.00 but now you are underpaid. I think you should talk to you management as this is against the law.
