hi siew/ ck,

i been working here for 2years & 6months. My company do not need me anymore & will terminate me. How many months they have to compensate me?

Since you have not given fuller details, roughly it can be:

1. Salary in lieu of notice;
2. Termination benefits @ 15 days wages per year x 2.5 years
3. Any annual leave balance.

If you are not happy with the termination, complain to the Labour Department or Industrial Relations Department.

yes. balance 5days of leave. they decide to pay by money. but 5 / 30days x my salary.

That looks like they are short changing you a bit, should divide with 26.

Personally, I tend to think so, by 22. But sometimes, the Labour Department may think it should be 26 because of that formula in Section 60I of the EA. Don't want to confuse you. Get the answer by asking the Labour Department. Let us know when you got the answer.
