Re: monthly salary pay

is the company have right to divide the monthly rate of pay to 30 days?since we here is sarawak and the employment act 1955 only can be used at west Malaysia?

I'm resign from my company by giving 1 month notice at 28 July, so my last day is 27th August. I still have annual leave 8.5days.

But the company required me to stay until 25th July only and so they will pay me the extra 8.5 days.

Here the problem - is the extra 8.5 days can be calculated by
(Basic salary / 30 days x 8.5days)?

According to Employment Act 1955, the most common formula for pay per day is pay/26 days. But the formula of pay/30 days is acceptable as long as the same formula is used for the cases of deduction and reimbursement . Yes, Employment Act 1955 only applies to West Malaysia only.

how to calculted the salary if my company working from 8.30am to 6pm 5 days working?
Is Basic salary / 26day or Basic salary / 22day?

According to EA 1955, it should be basic salary / 26 days, regardless of actual working days.
