Work more than 5 years
1)How many days of Outpatient Medical leave entitle by Malaysia labour law
2)How many days of Hospitalization leave entitle by Malaysia labour law
3)Are both leave to be combine as total or Outpatient Medical leave is part of Hospitalization leave.

Sec 60(F)
(aa) where no hospitalisation is necessary (Outpateint), --
(i) of fourteen days in the aggregate in each calendar year if the employee has been employed for less than two years;
(ii) of eighteen days in the aggregate in each calendar year if the employee has been employed for two years or more but less than five years;
(iii) of twenty-two days in the aggregate in each calendar year if the employee has been employed for five years or more; or

(bb) of sixty days in the aggregate in each calendar year if hospitalisation is necessary, as may be certified by such registered medical practitioner or medical officer:
Provided that the total number of days of paid sick leave in a calender year which an employee is entitled to under this section shall be sixty days in the aggregate;
And provided further that if an employee is certified by such registered medical practitioner or medical officer to be ill enough to need to be hospitalised for any reason whatsoever, the employee shall be deemed to be hospitalised for the purposes of this section.

Outpatient Medical Leave and Hospitalization Leave are regarded separately.

Is there any section in our labour law that states :-Outpatient Medical Leave and Hospitalization Leave are regarded separately.

Currently our company are deducting for each day - Out patient leave , it will also deduct 1 day Hospitalization Leave

my driver cause an accident during working hour. He admitted to hosptial 7 days. Doctor advised him to take rest at home 3 months. How many day he can take for hosiptalization leave?

Hi,

Pls help me to resolve my prob on my hospitalized leave. I was admitted at University Hospital for my further treatment sum where in February. My company declared my hospitalized leave and the mc under unpaid leave. When happened to query them, they were assumed that is the company’s rules and regulation. Pls advice!

I was admitted on the 15th April for an Appendix removal operation. I was discharged on the 16th April but was requested to rest at home for 1 week for the stiches to heal and before it could be removed. I would like to know the 1 week duration or healing period should be categorised as hospitalization leave or medical leave?

I just joined a company and was entitle for outpatient medical coverage of RM500 for my self, RM 200 for my spouse and RM200 for my children a year. My husband is also working at the same place with me who has been with the company for 6 years and he is entitle to RM300 for himself, RM150 for spouse and RM150 for his children. Now that I'm working with him and it's still under probation, the management decided to take away his coverage of RM150 for spouse and RM150 for his chilren and only could claim it under mine coverage. They even decided to take away the RM200 on my end that i could claim for my spouse seeing that both of us are working at the same company. Please help as I'm in dilemma. They took away Rm500 from us just because i just joined the company.

Can a company combine the entitlement of 60 days hospitalization leave together with my entitlement of 14 days sick ?
With this combination i am now entitled to a total of 60days leave for anything to do with medical leave regardless if it is out patient treatment or hospitalization.
Therefore i am now only entitled to 14days medical leave and only 36 days hospitalization!
Is this legal and correct for a company to enforce this on me.

hi, My lorry driver accident during working hours. his leg seriously injured and admitted hospital for 20 days. but doctor advise he have to stay home rest for at least 3 months.. should I pay him salary during his abscent?

Hai,i had an accident on 4th April 2012 on my way to works and on the first day i need to be admitted at the GH Hospital due to my left leg got bone fraction and the doctor advised me to rest at home for about 2 month.The first month on May my company had no issued to pay my salary but the second month they said they need to deduct my salary due to my leave+mc is not sufficient.Can i know in my case to rest at home for 2 month with a letter from the doctor and MC considered as 60days hospitalization or not?Please i really need to clarify on this matter.

Under S60F, there is 60days hospitalisation leave. how about MC given by doctor after the 60 days hospitalisation leave, entitle?

i would like to know that if MC for 5 days and sartuday and sunday is entitled for rest day or not? due i fel at my working place locker and my wrist bones are intant & my tissue are torn and my hr department says that im not entitled for off or rest day. please advice.

My staff is hospitalised in GH from 05/09/2012 and doctor adviced her to stay at the hospital until delievery of her baby which expected will be on 25/11/2012....
Can someone advice me on the Hospitalisation and Maternity Leave and how many days will be unpaid?

I know this is an old tread already but just want to clarified, ML and Hospitalization ARE NOT regarded seperately according to labor act.

The 60 days mentioned included ML and hospitalization. For example, you are on ML for 7 days today and tomorrow you are on hospitalization for 10 days, so this means 60 days - (7+10) = 43 balance OR if he is working less than 2 years = 7 days ML and 36 days hospitalized balance.

Just know this; ordinary MC allowed for the year is 14 days, for instance. If hospitalisation is involved, the number of MC allowed would go up to 60 days. In other words, MC and hospitalisation is the same thing and is limited to a total of 60 days IN AGGREGATE (this is the word used in the Act).

MC that is given for a staff to recuperate at hom after spending time at the hospital IS NOT deemed as hospitalisation; it is deemed as normal MC, unless the doctor states clearly in the MC that the period of recuperation at home is 'deemed hospitalisation' then it would be considered as hospitalisation and not ordinary MC.

i head that we can claim from SOCSO for the staff salary if he under the hospitalization leave, izit true?

Eg: Mr A on hopitslization leave for 35 days start from 1st aug, so SOCSO will pay the AUG Salary & 4 days for Sept??

I have a friend, facing company had stopped his medical benefit from Panel Clinic without any inform suffer.
my fren is waiting for GH specialist rotate check up report during this period (2 months). However, he's visited panel doctor to get consulations and medicine when he's really unfit to work. But, today, Panel doctor is accusing him too close to the sick leave, Doctor's reject to approve MC and Medical fess is not pay by company. According to the Doctor's said, the Company had complaint that stop given MC to this staff.
I am feel so sad, my friend is sick for long time, but still pending for GH report, seems suffer, but the Company had just stop his medical benefit and dont even allow him to stay and rest. I wish to know is that company had the rights to stop staff's benefit without informing ?

Hi All,

I would like to know bout my hospitalization leave.
I was admitted in hospital on 19th June and discharged on 20th June because of gyne minor surgery. I have been given hospitalization leave from 19th to 25th June as requested by doc to rest at home before i go for the next follow-up. Additionally my doc gave a letter saying that this will an hospitalized leave.

Is that any way the company still accept it as normal medical leave or should consider as hospitalization leave.

I am a Branch Manager, I have hurt my knee during work, Doctors said I have torn my meniscus and said I may need surgery. 1st treatment given was bed rest for 2.5 month which was on hospitalization leave from Jan2013 till Mac 2013. I went back to work, my knee swell again I could not walk. This time doctor said I have to go for surgery, I had my surgery 7th of June and now on Hospitalization leave again, Doctors said should not put pressure on my leg at least for 6 to 8 week.

Since I have finished my 60days hospitalization leave, company said I don't have salary for current hospitalization leave. It should be treated as No pay leave. But I am working from home, I am replying my email from home and communicating with my department on day to day jobs from home.

Do the company have to pay for this service or its should be treated as NPL.
Please advise.

You have the right not to work from home as you are taking your NPL. However, if your company requires you to work from home and your job scope itself does allows work location flexibility then your company should pay you full. But from your job title I would assumed your job requires you to be stationed or presents at your branch for at least a certain amount of hours. Hence, if your company does requires your service during your NPL to a certain degree, you will need to come to terms with your company/management on your salary issue like to be paid on a certain percentage or by days or hours of work service required.

I have been on mc for 19 days due to contigious eye infection how's mc going to be accounted . Paid or unpaid leave. I am with company for more than 7 years as most senior management employee. My whole family was infected.

Saya admitted hospital 1 day 14/10/14 and memohon hospital leave for 14/10-27/10. Lepas consult doctor continue mc 28/10-7/11. Company tolak gaji saya dengan alasan sosco akan bayar. Betulkah ini under undang-undang my labour law?
