Hi,

Would like to enquiry abt staff termination:

1) Can we talk with the staff to tender resignation by herself instead of terminated by the company due to committed a serious misconduct? in order need not to conduct Domestic Inquiry.

2) If the staff tender resignation by herself, is she required to serve 1 mth's notice or pay in lieu? as we do not want to keep her in the company anymore...

Do you think you can take such a easy way out? She may tell you "why should I". Anyway, if you think it is workable, you can always give it a try as I don't know how serious is that "serious misconduct".

If we terminate her after the DI and found she is guilty, do we need to give her 1 mth's notice or with immediate effect?

That will be instant dismissal if so decided.
However, that employee still has the right to seek redress either at the Labour Department or the Industrial Relations Department.

I have a staff that still under probation period . Within the period she at least took 4 days MC and 3 days UPL(average per month she took 1 day MC and 1 day EL/UPL) .she joined 1/9/10 and always late for work.Can we terminate her immediately?
