Good day to you, KL Siew. i would like to ask about the maternity leave.

According to the EA, its cover up to salary RM1500 and those below will be entitled for the maternity leave of 60 days.

My question :
1) If the staff salary is above RM1500, meaning she is not covered under EA and force to follow the company handbook / rules (if the company set a rule of only entitle for one month maternity leave) ?

2) The company have the rights to reduce the maternity leave 60 days follow their preference? (for those salary above RM1500)

I am not very clear of what you said. Are you saying the maternity leave in the handbook at present is 60 days and they company is now trying to reduce it to one month (for those with salary more than 1.5K)?

Yes, this is what i want to know. But is for those salary more than RM1500 but less than RM5000.

Although there is nothing to stop the company from doing that, it will surely make all the ladies very unhappy and that is not good for industrial harmony. It looks rather odd when all the lower paid staff are getting 60 days whereas the higher paid staff get only one month. I think the ladies can make a issue of it and approach the Industrial Relations Department see whether they can help to patch up the problem.

May I know if a employee had an early delivery due to the baby brain was under developing, will she entitle for maternity leave? or consider it as medical leave. The doctor has given 3 weeks medical leave. As a human resource dept, should I take it as maternity leave or medical leave?

To Lim, if the delivery was after 28 weeks of pregnancy then she is entitled to maternity leave with pay. The doctor concerned should be able to tell. Consult him.
