What is the different between Lay-off and Retrenchment.
If we would like to kick a Plant Manager which do not have ability and competency to in-charge a department and cause the whole division loss due to his inability. He is absolutely no competent to Plant Manager title. If he served 4 years + how much we have to pay him.

If his salary is over RM1500, the Employment(Termination and Layoff Benefits)Regulations is not applicable in this case. As such I cannot say how much to pay. How about making him an offer that he cannot refuse? Anyway, it's not going to be a straightforward case if you 'kick' him out for that reason.

He earned more than 5k a month. He is not covered by employment act 1955.
Mean he is covered by IR, Is he?

Can we retrench him by paying him such amount according to his total service years


Please advise.
