A staff of ours had taken to the maximum medical leave allowed 14days and it is only February 2008. Although no pay sick leave after the maximum but we could not have the position Not Manned.

We spoke to the staff and came to a conclusion that she is and will not be able to commit attendance like usual (she believes that she is being charmed). The management had to asked her to lay off and stop work. Until she is better she may re-apply again. She agreed.

Does the Management need to give her 1 month notice as she is a permanent staff (she likes to go off asap)? If we don't will we be penalised. Pls advise.

Since she has agree to go, ask her to tender her resignation and work out a package like giving some exgratia payment, all her balance of annual leave and so on, so that she will leave happy. In this way, she may not feel that she is being dismissed.
