My brother just started working, his basic pay is RM1000 per month. On OT matters, my brother has accepted a lower OT rate than the minimum industry (Labour law) rate for Sunday shift and Public Holiday shift. He has signed a side contract with the company.
Is this legal and can my brother challenge the company for the standard industry rate? Can he make a complain to the labour court?
