I have just resign from the company X at end of January. All is going well until i have received a letter from the HR department today (27 February 2008) indicating that i have several jobs that i need to complete before leaving the company . Failing to do so, will result them in holding back my February pay.
Are they even allow to do so, my pay is above Rm3500. Therefore is over the Rm1500 limit.
If they fail to pay you, go to the Labour Department and make a claim. Since your salary is still below RM5000, they still have the power to investigate your claim.
"69B. Additional powers of Director-General to inquire into complaints.
(1) Notwithstanding the provision of this Act, the powers of the Director-General under section 69(1)(a) shall extend to employees whose wages per month exceed 1,500.00 ringgit but does not exceed 5000.00 ringgit...."
When you don't receive your Feb pay, you personally go to the Labour Department. You tell the officer there that your former employer has failed to pay your Feb salary and you want to make a claim for it. The officer will take a statement from you and will tell you the details. You have to go to the Labour Department in the area where you worked for your former employer.
