Re: resigned staff

We have a staff joined us since year 2002 and resigned on 30 jun 08. We found out that he is taking job from our customers now. In the employement contract, we do have a clause that the employee cannot hold any interest wiv our client for 2 years after resignation. Anywhere, it is a new clause we added since year 2006 and this was not highlighted in his contract when he joined the company in year 2002. May I know we still can take lega action against him ?

I don't know how you are going to enforce such "restraint of trade" clause in the contract. Ask a lawyer whether he will do it for you.
