Re: Termination and Annual Leave


I have a problem with my ex – employers regarding my termination and annual leave. I submitted my resignation letter on 17 of Jun 2008 and my last working day will be 16 of August 2008. My manager and me agreed that my last working day would be 1st of August. I have 22.5 Annual left over, so I plan to take leave on 21 of July till 30 of July 2008 ( 8 working days) and will end my day on 31 of July 2008. My superior rejected my leave and told HR that I went on leave without his permission. But I did asked him about my leave before I went on leave, he told me he had rejected and in the conversation through the phone, he told me he would consider and called me back. At the end of the day, he never called me back as I went on leave.

When I came back on 31 of July, he told me that I went on leave without his approval. 31 July I went back to submit all the company’s properties and I left the company and he asked me to work on that particular day. I went off on the 31st July due to sickness and promised to come back on 1 of august because I forgotten to bring some of the company’s properties. On 1 August I went back to the office and returned everything and applied my remaining leaves. He refused to approve and told HR to issue a short notice letter. I felt that I have discriminated on my Annual leave which I entitle to take. In fact after cleared off my annual leave I have extra 2.5 days which the company has to payback me. What would be your advice to me in this kind of situation ?

Short notice means that I have compensate the company for not working from 1 August till 16 August.

Try to have the matter settled amicably with your HR. If that is not possible, you may have to approach the Labour Office or the Industrial Relations Department for help.

HR is on my superior side.. they backup with and not me!! if i brought this matter to Labour Office, wat's the possibilities of winning this case?

Not knowing the facts of the case, I really cannot tell . You can always ask the Labour Office if there is a case for you.after giving them the necessary details.

in fact what i could say is ..my annual have been discriminated and they are trying to ask me to compensate due to short notice! which is very unfair for me!
