Do i have to pay notice period if the employee has been continously absent from work for more than 3 days without informing anyone or apply leave. We have tried to contact him but still no reply. He has been with the company for a year & is still not a confirm employee.

In this case, understand that if either party breaks a contract of service, they are liable to pay to the other party equal to the notice period they are liable.

In fact the employee is deemed to have broken the contract of service. In such a case, it is like his terminating his service without giving notice and the employer can claim indemnity from him.

can we just dismissed him instead of termination. in this case, we have to paid him right? thank you.

Don't know what offence he has commetted. If for instance, he has been warned a few time for absent without leave, you just dismiss him without paying anything. For me I wouldn't bother to hold DI.
