you may use Employment(Termination and Lay off Benefits)Regulations 1980 as a guide for all the employees mentioned by you in 1 and 2. Go to http://www.pesaraonline.net/terminationbenefits.htm for details.
Below is Regulations 6 for your info.
"6. (1) Subject to the provisions of these Regulations, the amount of termination or lay-off benefits payment to which an employee is entitled in any case shall not be less than -
(a) ten daysí wages for every year of employment under a continuous contract of service with the employer if he has been employed by that employer for a period of less than two years; or
(b) fifteen daysí wages for every year of employment under a continuous contract of serviced with the employer if he has been employed by that employer for two years or more but less than five years; or
(c) twenty daysí wages for every year of employment under a continuous contract of service with the employer if he has been employed by that employer for five year or more,
and pro-rata as respect an incomplete year, calculated to the nearest month."
1. Due to company closure, one of my friends working for more than 5 years the VSS money is calculated 3 months wages for every year & some is 20days wages for every year.
Please let me know why is there 2 types of calculation and advise which is correct one.
2. Please also advise whether the wages of a staff more than RM1,500 will the labour office help out if any workers face difficulty on receiving VSS due to company closure or do we need to go to Industrial court directly.
