My salary is above rm5k and work 5 days a week (Saturday is my off day and Sunday is rest day)
I am in need of your assistance to clear my doubts as follows:
1) What should be the rate for working on off-days Currently the adopted calculation for off days i worked is Salary / 30 or i will be compensated as annual leave. Shouldn't it be Salary / 22 and not divided by 30 days ?
2) If i worked 4 days a week i.e. additional off day on Friday, is it the same formula as above will be applied ?
3) If i worked 5 hours (e.g. from 4pm to 9pm) on off day, should i be entitled to half day compensation ?
4) If working on off days is by force and no compensation as above, who can i get help from since I am not covered by employment laws ?
Since you are not covered by the Employment Act, there is nothing much I can comment. So, it looks like the current practice (divided by 30) will do. Try to negotiate for a better deal. I wonder if the Industrial Relations Dept can help you, but no harm trying to get some views from them.
