i commenced to work with a firm on July 23,2007 with basic salary of RM1,000. And on my offer letter dated 31 July, stated that i required to give 2-mth prior notice or in lieu of such notice, payment of one-mth salary without assigning any reason.
I received my confirmation & increment of RM100 in Nov 2007.
In Feb 2008, annual increment of RM200 so my salary become RM1,300.
On 5 May, 2008, i tender my resignation and on 23 Jun, i send a leave application form to my employer to apply leave from 27 to 30 Jun, 2008.
On 25 Jun, I receive a letter from my employer stated that if I leave without waiting for the expiry of notice, they will follow Section 13(1) of Employment Act, and ask me to acknowledge on copy of the letter for their record.
Do they have the right to take action according to what is written on the letter?

Do you have any balance of leave? Otherwise you are not entitled for leave and you will have to serve up to 4 July.
