I've been 7 ++ years with this company and work as an executive (salary more that RM1500/month) . On April 1st 2008, I've tendered my resignation letter and my last day will be this 30th June 2008 ( three months notice as per my offer letter). I was 4.5 months pregnant at that time. My delivery due date will be August 22nd 2008. I 've declared to the management on my pregnancy when i was 3 months pregnant. My question, in this case, am i entitle to have maternity protection benefit? since this case never happened in my company. And, there 's no policy/guideline about this (Maternity Protection).
For an employee who is covered by the Employment Act, she will be qualified for paid maternity leave. Under the Act, she is entitled as long as her confinement begins within 4 months from date of termination of service. Hope your company can use the Employment Act as a guide since you are not covered by it.
