1. If sick leave fall on the off day it self (which visit the doctor on the same day), is there any off day replacement? 2. If visit doctor at the night time and doctor issue the sick leave is for the nex day and coincidence is off day. Therefore, the next day is entitle for sick leave or off day? 3. What happen is a staff is on chicken pox sick leave - the duration is consider as 14-day sick leave or hospitalisation leave (as we know chicken pox is required home/traditional treatment)?
1. It is considered as sick leave and there will be no replacement for rest days 2. It is sick leave.
Please read the proviso of Section 59 of the Employment Act as quoted below for your info.
" 59 Rest day ....... Provided that this subsection shall not apply during the period in which the employee is on maternity leave as provided under section 37, or on sick leave as provided under section 60F, or during the period of temporary disablement under the Workmen's Compensation Act, 1952, or under the Employees Social Security Act, 1969......."
3. It should be ordinary sick leave and not hospitalization.
