Dear Sir,

Its a quite some times i didnt post any message here. but today i do hv 1 question which require me an answer.

May i know why for annual leave we can prorate but not for the sick leave?

Very simple, the Employment Act only states that annual leave can be prorated but there is nothing to say that sick leave can be given prorated.

My staff resign in May 2008 after 10 months working with me. She has taken 51/2 days leave and 8 days sick leave. In her appointment letter, it was stated that - Annual leave:14 days on completion of 12 months' continuous service but less than 2 years continuous service. Medical leave - Maximum paid leave of 10 days in a calendar year. Since her service with me is less than a year, can I deduct from her pay the leave she has taken?
