Under the employment contract, the person needs to serve a 3 months probation period. Due to poor work performance, it has been extended to another 3 months. This staff was served with ample notice of his bad work performance and HR has extended another 3 months of probation to the initial 6 months which was not readily agreeable with his supervisor and head of dept. Would the labour law considered this staff being an automatically confirmed staff after 6 months of probation, or would consider the additional 3 months of probation. This staff is also one who is very smart in defending himself and would know that the labour law can help him retain his position in this organisation and most relunctant to leave. How could we terminate his services within the labor law?
