Can you tell me is our labour law covered foreign workers??
I had a staff here said the labour law cover FW therefore we have problems on the workers' leave... Do we need to calculate their leave based on their working years same as our local staffs? Or we only need to follow contract signed? Please advice!

The Employment Act 1955 does not distinguish between local and foreign workers. About annual leave entitlement, the EA provides the minimum benefit.. If the annual leave entitlement in the contract of the foreign workers is better than what is provided in the EA, then it is alright, you follow the contract. If less favourable, then you must follow the EA.

Please consult the Labour Department also because they are the authority.

I hope you can clarify further on this. For General Workers, the minimum leave in the contract is 8 days. If the contract for the foreign workers spelt out annual leave entitlement for 3 years is 8 days, does this mean that on the 4th year on renewal, we would have to follow the annual leave in the Employment Act 1955 which would be 12 days.
