Happy New Year.

Can I refer to you some question?

a) We are working for 5days a week. Is the ordinary rate : Basic salary / Number of working days (exclude sat/sun)?


b) A staff with monthly salary RM1500 come back to work on Sunday (Rest Day) and she stay for 13 hours that day. How's the calculation for that day? My calculation :-

Daily rate : 1500/22 = 68.18
OT rate : 68.18/8 * 2times = 17.05
her pay that day is 68.18+17.05 = 85.23

is this correct?

The formula in Section 60I of the EA uses 26 as the denominator. There is no formula for places of employment working on 5-day week. I personally thnk 22 should be used for 5-day week places and there are companies also using 22 for ORP calculation. There is certain amout of uncertainty here and I would suggest to get the views of the nearby Labour Department.

my hubby had been asked to leave the company because he was told he was no manners to his senior while he was putting a box on the table but accidently the some items of hardware was fall down and hit his foot.
This was happen accidently, was the Management have the right to terminate the staff with immediate effect? What should we do? I will proceed a labour law complaint to Jabatan Buruh. Please assit us
