Re: Appoinment Letter - Confidentiality

If my appoinment letter stated: ~
You are not to be employed and/or be involved either directly and/or through nominees in any organization which is in the similar business of the Employer for a period of TWO (2) YEARS from the date of termination of your employment with the Employer in Wilayah Persekutuan Kuala Lumpur and/or Selangor Darul Ehsan and that you acknowledge that the remuneration under this employment had taken into consideration this restriction of employment after your termination thereto.

1) If I join another company with similiar field, any legal action will be current employer taken to me?

2) How about if I join the similiar field company but located out of Kuala Lumpur and Selangor, any action will be taken to me?

They may put in that clause but I do not know how are they going to enforce it. I wont worry so much about it.

You can consult a lawyer if they sue you, the lawyer will advise you what to do.
