Re: need help!!!

my company was winding up recently , but last week they ask me to sign up resignation letter provided from company which is back date to september without notice anything, juz say will transfer my salary to new company (which is already worked with him 5 months ago) . Until today I din get any offer or appointment letter from them yet, but receive 1 more proxy letter to sign to agree that the existing company is old me 8 days salary, should i sign it ? coz I din reliase and also already signed the resign letter before. What can do now???

I am not very clear about your problems, you better go to the Labour Department and get their advice.

不好意思,我的问题应该是问:公司在清盘前没向员工有做任何提示,而且要员工不知情知下签下辞职信和简单的说会将我们的新水转去新公司。然而至今已一个星期新公司的聘情书还没出,那员工现在可以做些什么?

看來給了辭職信對你們很不利。首先去問問新公司到底你們的情況如何。不然你們唯有上勞工局投訴了。

谢谢你的答案, 有听到消息是新公司执行人还是以前的老板, 那么情况会不会乐观点还是有一点点的保障呢?以下还有两个疑问:

1)那如果我的名字不在新公司的聘请名单里面或者它故意刁难(调动去很不方便还是很远的分行)那时是不是只有劳工部可以帮上忙?
2)其中有员工没有签到辞职信,他去劳工部投诉方案是不是和有签得不一样呢?

1。 如果你給了辭職信,老板可以不理睬你。你目前到底有沒有在新公司工作或是正在失業?你最好去勞工局了解一下。
2。沒有簽辭職信的是比較有利投訴。

其实全部的员工都一直在所谓的新公司(或者旧公司)工作着,程序上没什么分别,因为最高层还是同样的人,我们有没有权利向新公司争取comfirmation letter 而不是appoinment letter呢?
新公司有没有权利在新的聘请书里减低现有的薪金或者减少现有的福利呢?
那员工如果不接受条件那是不是要自动离职呢?
公司是自愿申请清盘那么去劳工部备案有没有牵涉到前者的日期呢?

I think you better read up the Employment(Termination and Layoff Benefits) Regulations at this link

如果信工作條件比舊公司差,就盡快向勞工局投訴。
