pls adv - employment stated medical leave entiled for 14 days, if the staff join on Jun09, can her medical leave prorated as 14/12 * 6 = 7 days for her first year ?

Medical leave cannot be prorated under the Employment Act. If you are not covered by the EA (meaning your salary is over RM1500) your employer can do that by giving only prorated mc.

if the staff not covered by the EA, can the employer automatically prorated the mc without giving any notice or did the employer need to put in as one of the company policy

To May, there is no law to say he cannot to that. Of course it is always to good to have a clear policy.

To Eric. Annual leave can be prorated.
