雇主不能解雇在分娩期的女员工。但相反的,女员工可否在分娩期像雇主提出辞职。 在这种情况下:
1. 雇主还需要照给那60天产假的薪水吗?
2. 或是雇主甚至可以进一步,向那女员工追讨赔偿,这样算是忽然间离职吗?

如果女職員說在產假過後就辭職,本人的意見是要看通知期是多久。如果通知期是一個月,就用一個月生產金來賠給雇主,2個月通知期就用2個月的生產金來賠。
如果該女職員真的有此辭職的打算,雇主最好把後果解析給她知道。
同時不妨也去勞工局多了解一下。

Would like to know if tender the resign letter before or during the materity leave did employer still give me the 60 day materity leave with salary?
My company need to give 2 mth notice, so can i tender my resign letter one week before the materity leave. then i still entiltled for 2 mth materity leave?
