Re: annual leave calculation

Hi, I would like to know how to calculate my annual leave if I start work on 21st July 2008 and tender my resignation letter on 21st Mar 2009? But my last day of working will be 20th Apr 2009.

According to my superior, annual leave will only be taken after 1 year of service. If she insist not pay back my annual leave, what should I do?

She never give me confirmation letter even though I asked from her before and also never give me pay slips start from 1st working day.

Since you are resigning, you are entitled to prorated leave for the number of months of service. It your entitlement is 8 days, you should get (8/12) x 9 months = 6 days. Take your 6 days leave before you go if they don't want to pay for it. If they don't want to grant you leave or pay you, complain to the Labour Office.

Your pay up to 20/4 will be (salary/30) x 20 and annual leave is 6 days.

Hi, I received my superior e-mail says that she had check with Labour Office and Labour Office staff told her if a staff never complete 1 year service for a company she is not entitled for the annual leave if she resign. Is she telling the truth? Cause for what I have check with you that is not true. So I just want to double confirm with you. Hope you don't mind!

Hi, I had check with the Labour Office at my area here. The staff told me I not entitled for the Annual Leave because I never complete 1 year in this company. So is this staff correct?

Read the latest labour law! At the new Labour Law website
