Re: Termination of Staff

want to ask about the termination of staff, our company need to terminate one staff beacuse of his service no good that company expect, then when we ask him to do something, he got many excuse to reject. I would like to ask what can i do for it? is it i need to write a warning letter to him or is it possible i terminate his contract within 24 house without warning letter? or what way that we can do to avoid any problem happend (we afraid that he will sue us cause of no reasonable to terminate him). Please reply me asap. Thanks

You didn't mention how long he has been working for you. If you have no choice, just sack him without notice. Let him complain to the Labour Department and you will pay whatever the Labour Department asks you to pay. There is really not such a big problem.

he had work here around 1.5 years, but for compensation claim from him, that is not fair to us to pay him because he is the one who dont want cooperation with us. I just want to know any documents that i need to prepare for example warning letter first or i can go staright away to fire him? if compensation , refer to your exeperience, how much need to pay if we fail?

1.If you just want to warn him, give him a warning letter telling him not to do certain acts.

2. If you want fire him without notice, you will have to pay one month salary as indemnity in lieu of notice and 15 days salary as termination benefit plus payment for whatever balance of annual leave not taken.

3. Alternatively, he may make a claim for reinstatement(to be given back his job) at the Industrial Relations Department.
