请问,

如果这年年假没有拿完,
在劳工法令内有没有说可以带到明年。。。

可以带多少天和多久 ??

一些公司規定年假一定要拿完不准許帶到明年,一些公司只准許帶幾天到明年。

勞工法令第60E(2) 有此說明﹕

(2) The employer shall grant and the employee shall take such leave not later than twelve months after the end of every twelve months continuous service and any employee who fails to take such leave at the end of such period shall thereupon cease to be entitled thereto:

Replacement Leave

Since you mentioned that the ANNUAL LEAVE cannot be bring forward fter 12 servicing months, how about the "Replacement Leave"? If the employee also fails to clear such leave at the end of such period (12 months), could the employer also reserve the right to hold back and cancel the "Replacement Leave" ? If not, what is the term and codition is applied? TQ

The simplest thing to do is to clear all available leave be it ordinary or replacement leave and go and have a good rest.

Thanks for the prompt reply. Good suggestion. Actually I am the newly join admin executive of a company. It suprising for me to fid out that the employees of this company still have plenty of the Replacement Leave and the Annual Leave which carry forward from year 2006 and 2007 yet to clear. The employee involve is mostly the foreign labours. My concern is, am I have the right to "Burn" their Replacement Leave. (I have given the notice to inform them to clear their asap 3 months ago). According to the policy of this company that its not allow to convert any type of leave to "money payment". Kindly advise
