Re: 如何处置被控偷窃罪的员工?

最近因为公司发生了窃案,负责人报了警而警察也逮捕了几个员工。目前在待审阶段,案子还没下判。

1。 由于他们已缺席几天(当事人没有通知公司,是通过警方才知道的),公司可否当他们absconded,自动离职?还是仍需要给他们show cause letter并举行DI?

2。 由于案子尚未结束,若该员工在回复show cause letter 时否认偷窃,公司应该怎样采取行动?

3。 若当事人已在口供中承认偷窃但可能因证据不足而获无罪释放,但公司也不想继续留下他们。可否要求他们自动辞职?

如果是因被警方扣留而不能上班,公司不能当ABSCOND看待。

如果公司有充足证据可以进行DI然後处罚。若是没有,又不想留他们最好以妥协方法处理,试看可否补偿一点劝他们自动辞职。

那么他们现在是应该被当作休假吗?公司应该现在或等到法庭正式下判后才做DI?

1。 請看以下勞工法令第23條﹕

23. Wages not due for absence from work through imprisonment or attendance in court.

Wages shall not become payable to or recoverable by any employee from his employer for or on account of the term of any sentence of imprisonment undergone by him or for any period spent by him in custody or for or on account of any period spent by him in going to or returning from prison or other place of custody or for or on account of any period spent by him in going to, attending before or returning from a court otherwise than as a witness on his employer's behalf.

2。 這就有可能等上幾年了。 如果有證據就做DI,不用等法庭的裁決。如果有疑問你最好請教你們的公司律師,勞工局或 Industrial Relations Department。

谢谢!

我已经给他们show cause letter,同时他们也已书面回复,承认错误并愿意自动辞职,但恳求公司撤销控状。

是否撤销控状不是我的职责范围。既然他们已在信中承认犯错,想必公司可以开除他们吧?

既然他們愿意自动辞职,還開除什麼。你們的事可能複雜最好問律師。

对不起,我的意思是接受他们的自动辞职。

基本上人事方面已算解决,有关案件方面的事宜则已交由公司代表律师处理。
