First of all, thanks for your helpful.

I've working under a contract company with employment letter. Attached with the employment and confirmation letter have written my position and the company "A" which I given my service during my stay from March 2008 until present. Recently, company "A" is preparing to terminate my service because they transfer the business back to HQ. Below are the situation happen :

Case 1

Contract company will like to transfer me to company "B". Will I entitle for the compensation before I transfer to new company? Refer to the employment letter is not mentioned for the transferring matter. If I entitle the compensation ? How the caculation ?

Case 2

If contract company have given notice to me without letter (follow the employment letter 1 month notice ), would I still entitle for any compensation ? Please advise.

Waiting for your reply…….

Case 1, Because of your very short period of service, you are not entitled to any termination benefit or 'compensation'. Under the Employment (Termination and Layoff Benefits)Regulations, you have to have at least 12 months of continuous service in order to qualify for termination benefit, which is 10 days wages for every year of service for the first two years of service. Read the Regulations for details with

Case 2. I think the best thing you can do is to accept the transfer. You will not be out of job at least. Just forget about the 'compensation' if I were you.
