My working hour is 8.30am to 5.00pm from monday to friday.My company policy is from 5.00pm to 6.00pm will not be reimburse as OT CLAIM, but started from 6.00pm will only considered as OT. And i have to stay in office for at least 1 more hour from 6.00pm only entitled to enter the OT CLAIM.But this "strangeful" provision already stated in my agreement letter when the 1st day i came in this office.My question is,is it legally? How and can i rescind it?

It is strange indeed. If you are covered by the Employment Act, there will be no problem because anyone working more than 8 hours will be entitled to OT. If you are not covered by that Act, consult the Industrial Relations Department if there is anything that can be done.

The 8 hours working time included the lunch one hour?

请问我们一个星期工作5天,每天工作9个小时30分,请问当中的工作时间是包括了1个小时的吃饭时间吗?
如果是工作6天,每天工作8个小时,那么1个小时的吃饭时间也包括在内的吗?
不好意思,由于全公司再为这个问题而几乎要发生暴动了,如果可以,请尽快帮我解答这个问题。
