请问:

如果一位员工在工作已有十个月(未满一年)的情况下是否能拥有有薪年假?

1. 年假是工作满一年以上才能拥有8天年假,未满一年的员工是无法享有年假,还是以该员工已工作了的月数以arn的方式来计算?

2. 如果员工工作了一年又四个月后辞职,那年假又该如何计算呢?

1. 是的,未满一年的员工是不能享有年假。不过雇主愿意以月数计算那也可以。

2。 第一年8天,4个月是: (8天/12)x4

若是在该辞职的员工已工作了一年又四个月,雇主是否应该把之前那一年的年假(8天)和四个月[(8天/12)x4 ]一起计算会给他呢?(假设雇主在第一年没给于任何年假)

i joined at this company since 02/05/97, i have a question is did company can direct deduct my feb salary for 1day unpaid leave, her calculation as follow: 18 day annual leave / 12 months = 1.5days per month, (jan08 taken annual leave 1 day, in feb08 chinese new year compulsory leave 2 days, i had taken 2 days annual leave due to my daughter sick). her reason is i cannot on annual leave exceed 1.5day entitle leave per month.
I would like to know that why cannot deduct within the 18 days annual leave instead of unpaid leave, can i complain of this case... pls advise..thank you

我又21 天年假。 如果3 月辞职。2 个月通知。

公司一位员工在01/072006 加入公司.
30/06/2007满一年,年假8天.(清完了)
他在30/06/2008 辞职,一个月的通知LAST DAY是31/07/2008

01/07/2008又是新的一年年假(8天)
那么,雇主应该付他8天的有薪假吗?(如果他不打算清掉)

享受年假是指在同一工作做满一年的才能,还是从参加工作起,无论是在同一单位还是不同单位,即使中间有间断,只要工龄累计相加满一年就可以享受年假.
