I had a child on 17th Nov 2007. A day after my birth, the office manager came to visit me and told me that my boss was terminating me. I was very devastated and my blood pressure became vey high, due to that i had to stay an extra day in the hospital to stabilize.

After 2 weeks, i was told by my office manager that my boss decided not to terminate me. However, everything was verbal and nothing documentated. I am due to go back to work on 16th Jan 2008, however, when I asked my bosses wife who is also a director in the company, she messaged me saying that I am on 60 working days maternity leave. which means that I am only suppose to be back on the 4th Feb 2008. Is this right? I am afraid that thay will than terminate me stating that i did not turn up for work. Should I confirm the sms messsage maybe an email? Are there any other alternatives.

My other co workers have been telling me that my boss has cleaned up my place and placed all my things in a box. he has reformatted my lap top. he has even taken back the company sim card which was given to me. I am a business development manager. My salary is 6500 per month. Can i go for constructive dismissal?

Maternity leave is 60 days and not 60 working days. You should report back to work on 16 Jan or as per MC given by the maternity hospital. For the time being, don't listen too much what others have been telling you. Report back to work and find out yourself. If they really don't want you, let them tell you. Only after that you can take up a case against the company. The Industrial Relations Department is the place for you to seek redress.
