Re: termination during probition

my staff start working 1st May 07. Todate her probition is already overdue for 1 1/2 month. she is underperform with lots of leave and sick leave which i need to terminate her. Please advise, temination without breaking labour law.

If she is not performing well, you will have to give her advice or written warnings to improve herself. If there is still no improvement after a few warnings then you may terminate her service. If the leave was approved by you then you have to do something about it. Get her to see your company doctor instead of any doctor she chooses to see.
