Re: The rights of Labour Law Officer

A man came to my office yesterday claimed himself as an officer from labour law office. He first came to show me my name card, then claimed himself as an officer and asked me to hand out all my staffs' appointment letter and salary slips for him to check. When I asked him to show his ID card, he got furious and told me if I don't want to co-operate he will report to office and ask me to bring my lawyer. To avoid troubles, I showed him the letters and I found that a copy of mine gone missing after he left, I suspected he has taken it.
The question is I read from the Labour Law Reference Book,
1. if an officer is to come and check your stuffs. There will first send you a notice to inform you when are they coming.
- But I didnt receive any letter from the department.
2. the officer should have the authorized pass for him to come for checking.
- But he did not have that. And kept threatening me to go to office if I don't co-operate.

Now I desperately want to know if it's reasonable for him to have such act?????

All labour officers are issued with an authority card to be shown to employers. Normally genuine labour officers don't behave the way as described by you especially asking you to bring along a lawyer. If you got his name of the officer you can alway check with the labour office concerned.
For routine inspections labour office will issue notice to employer so that the employer will be around, and documents to be ready for them to inspect. But there are occasions when prior notice is not suitable and officer can at any reasonable time to pay employer a surprise visit to check on certain complaint and so on. In your case you can always visit the nearby labour office to check it out.

especially one copy of my staff's appointment letter gone missing after i passed to him for inspection?

even though he is allowed to visit us without prior notice. But he still needs to get an authority card, and he also didnt have it.

Very simple, just go to the Labour Office concerned and look for that guy. If he is the one, ask for the letter to be returned to you. You better talk to the boss there about the incident
