Hi! I find your website to be most refreshing....

I have a situation which I hope you could shed some light on. I m not covered under the EA as my salary is above the threshold stated. I recently conducted my confirmation appraisal with my employer and was informed that I would not be given any confirmation or annual increment coz they had hired me at a higher salary scale.

Prior to me signing the Letter of appointment, HR informed that in normal circumstances, there will be annual increment unless your performance is very bad. My superior has appraised me and state that my performance meets expectation.

However my superior informed that mgmt had already decided when they hire me that there shall not be any increment to be given. However, this info was never communicated to me whereas the opposite as above was informed. when i told him that this was not communicated to me, his exact reply was "it was intentionally not communicated to you". even the HR personnel is not aware of this "intention" as he was also not informed about it and there is nothing stated in my file of this "intention". I feel like I had been cheated. if i had been informed prior to joining them, i could still be in the position to negotiate or chose not to join them at all.

Is there any action i can take against the co. as I feel that this is intentional witholding of information which effects me and also a case of misrepresentation..

If you are talking about sueing the company for withholding information or misrepresentation, you will have to get a lawyer to do it for you. But personally I think it is really not worth the while. Consult a lawyer if you really want to.

Their reason they hired you on a higher salary scale may not be a sound one for not confirming you. Talk to them frankly about your performaance or whatever they have got in mind so that you can improve on it and not for them by giving lame excuses.

I really cannot give you a proper advice.

Thanks for your prompt reply. I totally agree that sueing them would be a waste of time and resources. I thought that maybe I could seek assistance from the Labour office or IR office since my employers are foreigners.

I have been confirmed without any increment on confirmation on 1.12.07 and there will not be any annual increment as well for 2008. On record in my appraisal form, it has been clearly stated that he is satisfied with my performance and I have met up to their expectations.

As you say, this is just a lame excuse.

The IR Department will be a more suitable place for you to consult. Pay them a visit when you are free.
