I am one of the employee (executive) in a private company. By end Oct, i received memo from my HR dept. asking all employees to carry forward maximum 7 days annual leave earned in year 2006 to 2008. The balance of annual leave needed to be clear before Jan 2008. In my case, i have 13 days annual leave (which out of 13 days, i need to clear 6 days by Nov and Dec), the balance 7 days i am allowed to carry forward. However, when i want to clear 6 days leave in Nov and Dec, my superior does not allow me due to the reason that it is very busy in Nov/Dec and he need me to help him to complete some works. So i request to carry forward the leave, but HR dept would not allow me. HR ask me to forfeit the leave if my superior insist not allow me to clear leave. Do my superior have the rights to stop me from clearing the leave? Are their action against the employee act? What should i do? What law can cover for my benefits? Shall i take any legal action to sue the company? Please advice. Thank you.
